Twice a
year, in April and October, both the Standing Chapter 13
Trustee's staff and debtor attorney offices are deluged
with calls, and letters, regarding the Trustee's Report
of Receipts and Disbursements. Periodically, some debtor
attorneys complain to the Trustee," why do you keep
sending out those reports?"
An easy
answer is that the Standing Chapter 13 Trustee is
required to send out these reports by the United States
Department of Justice, Executive Office of the United
States Trustee. A more thoughtful response is that it is
good policy conducive to debtor rehabilitation to have
the debtors understand their plans and to have
individuals involved in the process. Moreover, financial
auditors applaud the process as a good internal control
and safeguard of accurate disbursements.
The
Trustee's office sends the report to the debtor and to
the debtor's attorney. An accompanying "negative
confirmation" letter advises the debtors to review
the report carefully and to contact their attorney or
the Trustee's Office immediately when they do not
understand something. A sample Trustee's Report of
